Misconduct

William Gillon's professional or personal conduct, was found to be in breach of the Code of Professional Ethics and to have posed a risk to the public or was likely to undermine public confidence in the Association or its members; namely:

1.He failed to comply with his obligations under the relevant Money Laundering Regulations while providing accountancy services to the public, specifically:
1.1 From on or around 1st January 2018 until on or around 16 August 2022, he failed to carry out an adequate risk assessment and  ongoing monitoring in respect of one or more clients.
1.2 From on or around 1st January 2018 until on or around 16 August 2022, he failed to carry out any or any adequate firm-wide money laundering risk assessment.
1.3 From on or around 1st January 2018 until on or around 16 August 2022, he failed to carry out any or any adequate periodic review of his Anti-Money Laundering policies, procedures, and controls.
1.4 From on or around 1st January 2018 until on or around 16 August 2022 he failed to have in place any or any adequate documented Anti-Money Laundering policies, procedures, and controls.
1.5 From on or around 1st January 2018 until on or around 16 August 2022, he failed to have in place adequate systems for Record keeping and Data protection for one or more of his clients.

2. For an unknown period up until on or around 16 August 2022 he failed to issue any or any adequate letters of engagement to one or more clients. 
3. For an unknown period up until on or around 16 August 2022, he failed to receive and hold clients’ money in accordance with AAT’s Clients’ Money policy.
4. For an unknown period up until on or around 16 August 2022, he acted as a trust or company service provider (TCSP) without being approved to do so.
5. For an unknown period up until on or around 16 August 2022, he provided Independent Examinations to one or more clients without being approved to do so.
 
 
 
 

Finding

Grounds for disciplinary action existed and the matter was suitable for exercise of the Investigations Team's powers under the Disciplinary Regulations.

Order

William Gillon is hereby:
1.Severely reprimanded for two years (24 months)
2.Fined £3,500.00 

Consent

William Gillon consented to the decision of the Investigations Team in accordance with Regulation 5.3 of the Disciplinary Regulations 2024.
