Misconduct
Tendayi Goneso was found to have committed an act or omission that falls short of the standards reasonably expected of him, including but not limited to those matters listed in the Code of Professional Ethics, which brings, or is likely to bring, discredit to him, the accountancy profession or AAT; namely:
1. He received a tax refund amounting to £3,227.00 on behalf of X into his business account and retained it without their consent from around 13 June 2023 to around 14 January 2024.
2. He presented tax returns to HMRC in the name of X, without their authorisation on or around the following dates:
(a) 26 May 2023
(b) 25 July 2023
3. He filed accounts to Companies House in the name of X, without authorisation on or around the following dates:
(a) 04 August 2020
(b) 21 November 2021
4. To the financial detriment of X, he failed to adequately respond to one or more requests for information from another firm of accounts in respect of the former client.
Finding
Grounds for disciplinary action existed and the matter was suitable for exercise of the Investigations Team's powers under the Disciplinary Regulations.
Order
Tendayi Goneso is hereby:
- Expelled from AAT for a period of three years (36 months)
Consent
Tendayi Goneso has agreed to submit to the decision of the Investigations Team in accordance with Regulation 5.3 of the Disciplinary Regulations.
